Hypley.ai Privacy Policy

Account Information. When you create or manage a Hypley.ai account, we may collect information such as:

• name
• business name
• email address
• telephone number
• mailing or business address
• username
• account identifiers
• account preferences
• company information
• information required to administer your account

Business and Advertising Information. We may collect information relating to your business and advertising activities, including business category, products and services, advertising objectives, campaign budgets, campaign settings, target audiences, advertising performance data, campaign history, advertisements, images, videos, text, logos, landing-page information, website URLs, and other content you submit to Hypley.ai.

Hypley.ai may allow you to connect third-party advertising or social-media accounts. These may include TikTok, Facebook, Instagram, Meta advertising services, Google, YouTube, and other supported advertising or marketing platforms. When you authorize a connection, the applicable platform may provide Hypley.ai with information necessary to perform the services you request.

Depending on the platform and permissions you approve, this information may include advertising account identifiers, business account identifiers, page or channel information, campaign information, ad group information, advertisements, advertising performance statistics, audience or targeting information, account status, campaign budgets, billing or spend information, media assets, and authentication or authorization tokens. Hypley.ai will only seek access to information reasonably required to provide the functionality you request.

When you connect a third-party advertising account, you authorize Hypley.ai to interact with that account within the permissions you have approved. This may include the ability to create advertising campaigns, submit advertisements, upload creative materials, retrieve advertising data, review campaign status, retrieve performance information, pause or modify campaigns where authorized, manage advertising settings, and perform other activities that you specifically authorize.

Connecting an account to Hypley.ai does not transfer ownership of that account to Hypley.ai. You may be able to revoke Hypley.ai's access through the applicable third-party platform.

When third-party platforms use OAuth or similar authorization technology, Hypley.ai may receive an access token rather than your actual password. Where possible, Hypley.ai does not request or store the password you use to access TikTok, Facebook, Instagram, Google, YouTube, or another third-party platform. Access tokens may be securely stored for as long as reasonably necessary to maintain the account connection you authorized. Tokens may expire or be revoked by you or the applicable third-party platform.

Hypley.ai may collect and process content you upload or submit, including advertising videos, images, graphics, music or audio, text, advertisements, descriptions, offers, product information, logos, testimonials, landing-page information, and other promotional materials.

We use this information to provide Hypley.ai services, including reviewing, processing, formatting, optimizing, creating, managing, and submitting advertising content. As explained in our Terms of Service, Hypley.ai may review advertising content for compliance before submitting it to a third-party advertising platform.

Some Hypley.ai services may permit businesses to provide customer, lead, audience, or marketing information. If you provide personal information relating to another individual, you represent that you have the authority and lawful basis necessary to provide and use that information.

You are responsible for complying with applicable privacy, advertising, anti-spam, and data-protection laws regarding information you provide to Hypley.ai. Hypley.ai may process such information solely as reasonably necessary to provide the services requested by you.

When you purchase services, fund an advertising campaign, or add money to a Hypley.ai wallet or account balance, we may collect or process payment-related information. Payment transactions may be processed by third-party payment processors.

Depending on the payment method, information may include billing name, billing address, transaction amount, payment status, payment method, partial payment-card information, transaction identifiers, and purchase history. Hypley.ai may not directly store full payment-card numbers where payment information is processed through an authorized payment processor.

Where Hypley.ai provides a wallet or prepaid advertising balance, we may maintain records relating to wallet balance, funds added, advertising spend, credits, refunds, adjustments, campaign allocations, and transaction history. This information is used for accounting, customer support, fraud prevention, and delivery of Hypley.ai services.

When you use Hypley.ai, certain information may be collected automatically. This may include IP address, browser type, device type, operating system, login activity, pages viewed, features used, referral source, approximate geographic region, date and time of access, interaction with the platform, and technical logs. We may use this information to operate, secure, improve, troubleshoot, and analyze Hypley.ai.

Hypley.ai may use cookies, pixels, local storage, and similar technologies. These technologies may be used to keep users signed in, remember preferences, maintain security, understand how users interact with the platform, measure website performance, improve our services, analyze traffic, and support marketing activities.

Where required by applicable law, Hypley.ai will seek appropriate consent before using non-essential cookies. Users may also manage cookies through their browser settings. Disabling certain cookies may prevent parts of Hypley.ai from functioning correctly.

Hypley.ai may use information for purposes including:

Hypley.ai may use artificial intelligence, machine learning, automation, or similar technology to help provide services. These technologies may be used for generating advertising content, providing suggested advertising copy, analyzing campaign information, assisting with content compliance, recommending advertising strategies, optimizing campaign settings, providing automated customer support, and improving platform functionality.

Customers remain responsible for reviewing advertising materials and ensuring that content is accurate, lawful, and appropriate before publication. Hypley.ai may also conduct human review of advertising materials.

Hypley.ai may review submitted content to determine whether it appears to comply with Hypley.ai's Terms of Service, Hypley.ai's advertising standards, TikTok advertising policies, Meta/Facebook/Instagram advertising policies, Google and YouTube advertising policies, applicable law, and other relevant third-party platform requirements.

Content-review information may be retained as reasonably necessary to administer accounts, document compliance decisions, prevent repeated violations, and protect Hypley.ai's advertising relationships.

Hypley.ai does not sell your personal information simply because you use our platform. We may disclose information when reasonably necessary to operate Hypley.ai. This may include disclosure to TikTok, Meta, Facebook, Instagram, Google, YouTube, payment processors, cloud-hosting providers, analytics providers, communications providers, software vendors, security providers, professional advisers, contractors, and other service providers. These companies may process information according to their own terms and privacy policies.

When you instruct Hypley.ai to submit advertising to a third-party platform, information necessary to create and operate that advertisement may be provided to that platform. Advertising content submitted to TikTok may be processed by TikTok according to its applicable privacy policies and advertising terms. Advertising submitted to Meta platforms may be processed according to Meta's applicable policies. Advertising submitted to Google or YouTube may be processed according to Google's applicable policies.

Hypley.ai does not control how third-party platforms independently process information once it has been provided to them.

Hypley.ai may engage third-party companies to assist with hosting, database management, email, customer support, payment processing, advertising, analytics, cybersecurity, artificial intelligence, software development, communications, and other technical services. We may provide these providers with access to information only where reasonably necessary for them to perform services on our behalf.

We may disclose information where reasonably necessary to comply with applicable law, respond to lawful court orders, subpoenas, government or regulatory requests, investigate suspected fraud, enforce agreements, protect our legal rights, protect the security of Hypley.ai, protect users or the public, or prevent illegal activity.

If Lead Source Software Inc. or Hypley.ai becomes involved in a merger, acquisition, financing transaction, corporate restructuring, sale of assets, or similar business transaction, information may be transferred as part of that transaction. Any successor organization would be expected to process personal information in accordance with applicable privacy law.

Some of Hypley.ai's service providers and advertising partners may operate outside Canada. As a result, personal information may be transferred to, stored in, or processed in other jurisdictions, including the United States. When information is processed in another country, it may be subject to the laws of that jurisdiction and may be accessible to courts, law-enforcement agencies, or government authorities in accordance with local law.

Hypley.ai retains personal information only for as long as reasonably necessary for providing services, maintaining accounts, completing transactions, maintaining campaign history, resolving disputes, preventing fraud, enforcing agreements, maintaining security, meeting accounting requirements, and complying with legal obligations.

Different categories of information may be retained for different periods. When information is no longer reasonably required, Hypley.ai may delete, anonymize, or securely dispose of it, subject to applicable law.

Customers may request closure or deletion of their Hypley.ai account. Certain information may continue to be retained where reasonably required for outstanding transactions, payment records, tax or accounting obligations, fraud prevention, legal requirements, dispute resolution, or enforcement of our agreements.

Deleting your Hypley.ai account does not necessarily delete information independently stored by TikTok, Meta, Google, YouTube, or another third-party service. Customers may need to contact those platforms separately regarding information controlled by them.

You may be able to disconnect a linked advertising or social-media account through Hypley.ai or directly through the applicable third-party service. Once access is revoked, Hypley.ai will no longer be able to access new information through that authorization unless you reconnect the account. Some previously obtained information may be retained where reasonably required for records, security, legal compliance, or previously completed transactions.

Hypley.ai uses reasonable administrative, technical, and organizational safeguards intended to protect personal information. These may include measures relating to access control, authentication, encrypted communications, secure hosting, monitoring, logging, employee and contractor access restrictions, and security procedures.

However, no internet service, database, or computer system can be guaranteed to be completely secure. Customers are responsible for maintaining secure passwords and protecting access to their accounts.

If Hypley.ai becomes aware of a privacy or security breach involving personal information, we will investigate the incident and take appropriate steps based on the circumstances. Where required by applicable law, Hypley.ai will notify affected individuals and appropriate regulatory authorities.

Depending on where you live, you may have rights concerning your personal information. These may include rights to request access to personal information, request correction of inaccurate information, withdraw certain consent, request deletion where permitted, ask questions about how your information is used, request information about third parties to whom information has been disclosed, and submit a privacy complaint. Some rights may be subject to legal exceptions.

Lead Source Software Inc. operates in Canada. Hypley.ai intends to process personal information in accordance with applicable Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA) where applicable, together with applicable provincial privacy laws. Where another privacy law applies to a particular user or activity, Hypley.ai will take reasonable steps to comply with the applicable requirements.

Where consent is the appropriate legal basis for processing personal information, Hypley.ai will seek meaningful consent appropriate to the sensitivity of the information and the circumstances. Consent may be express or implied where permitted by law. You may withdraw consent to certain processing, subject to legal or contractual restrictions and reasonable notice. Withdrawal of consent may affect our ability to provide certain services.

With appropriate consent or where otherwise permitted by law, Hypley.ai may send customers communications concerning product updates, new services, features, offers, educational materials, advertising opportunities, and other business communications. Users may unsubscribe from promotional emails using the unsubscribe mechanism provided in those messages. Hypley.ai may continue to send non-promotional communications necessary to administer an account or provide requested services.

Hypley.ai is intended primarily for businesses and adults who are authorized to manage advertising campaigns. Hypley.ai is not intended to be used directly by children. We do not knowingly seek to collect personal information directly from children in circumstances where parental or legal consent is required. If we become aware that information has been collected improperly from a child, we may take steps to remove it.

Hypley.ai may contain links to websites, platforms, or services operated by third parties. We are not responsible for the privacy practices of third-party websites or services. Users should review the privacy policies of those services before providing information to them.

We may update this Privacy Policy periodically to reflect changes to Hypley.ai, new features, changes to third-party advertising platforms, changes to applicable law, or changes to our business practices. The updated policy will be posted on the Hypley.ai website with a revised Last Updated date. Where required by law, additional notice may be provided regarding material changes.
